Terms of Use

These Terms of Use govern access to and use of the Kabiten AI service, a mobile application for recreational maritime navigation assistance.

1. Service

Kabiten AI is a recreational navigation aid provided "as is". Access to the service is currently free of charge.

2. User Account

The user is responsible for the information provided during registration and for maintaining the confidentiality of their login credentials. The user agrees to provide accurate information and keep it up to date.

3. Navigation warning — NOT FOR NAVIGATION

This application is NOT an official navigation instrument within the meaning of the SOLAS (Safety of Life at Sea) convention. It does not in any way replace certified nautical charts, regulatory navigation instruments, or good seamanship. Chart data displayed (ENC S-57, OpenStreetMap, OpenSeaMap) is provided for informational purposes only and may contain errors, omissions, or be outdated. GPS, tidal, and weather data may be inaccurate. The user remains SOLELY responsible for the safety of their navigation in accordance with Rule 2 of the COLREGs (International Regulations for Preventing Collisions at Sea). The user MUST use official nautical charts and regulatory navigation instruments in addition to this application.

4. Disclaimer of warranty

The service is provided without any express or implied warranty of accuracy, reliability, completeness, availability, or fitness for a particular purpose. Interruptions, changes, and adjustments may occur without notice.

5. Limitation of liability

Kabiten AI disclaims all liability for any direct, indirect, material, bodily, or immaterial damages related to the use of the application, including but not limited to: grounding, collision, damage, injury, loss of business, or any other navigation incident. Kabiten AI's liability shall in no event exceed the amount actually paid by the user for the use of the service during the preceding twelve (12) months. The user acknowledges that they use the application at their own risk and under their sole responsibility.

6. Indemnification

The user agrees to indemnify and hold harmless Kabiten AI, its officers, employees, and partners from any claim, complaint, legal action, damage, or cost (including attorney's fees) arising from the use of the application or violation of these Terms of Use.

7. Force majeure

Kabiten AI shall not be held liable for any failure to perform its obligations resulting from force majeure as defined by Article 1218 of the French Civil Code, including but not limited to: natural disasters, infrastructure failures, network outages, cyberattacks, government decisions.

8. Applicable law and jurisdiction

These Terms of Use are governed by French law. In case of dispute, an amicable resolution is preferred. Failing amicable agreement within thirty (30) days, the French courts shall have exclusive jurisdiction.

9. Changes to Terms of Use

Kabiten AI reserves the right to modify these Terms of Use at any time. Changes will take effect upon publication. Continued use of the service after modification constitutes acceptance of the new Terms of Use.
